Question on Sexual intercourse outside the marriage
« on: February 04, 2016, 05:29:02 PM »
I have a question. If a man & woman had sexual intercourse outside the marriage bond secretly & few years later they realized & made amends & repented to GOD. Would 100 strips of flog be still applicable for them?

Salam Sstikstof,
No they wouldn't. If they were catched by at least 4 people during the act, and they saw the act with their own eyes, yes they would be flogged. But if noone saw them and after a few years they are already repented and mended their ways, then no, even if it is revealed what they did in the past, they won't get flogged. Bcs Allah is always accepter of repentance, so after almost every punishment ascribed in the Quran, the following line says "except those who repent and mend their ways". For more clarity, check surah Noor.
Salam :)

Salamun Alaikum Seraphina, Most of the scholars said that if authority have acknowledged what they did after few years later, though they repented & mended, same punishment would be issued. Indeed, they advised that not to reveal at any case, it is between the person & GOD. How do you see this opinion?

Salam Sstikstof, I would like to comment on your question to Seraphina. The authorities can only declare punishment if the act was witnessed by 4 people.

4 witness only applicable for verse 24:4, not for verse 24:2. Here question was about future acknowledged situ by authorities. So will flogs still be due?

Salaam Sstikstof,

I disagree with you when you say the following:

Quote
4 witness only applicable for verse 24:4, not for verse 24:2.

I believe otherwise. I believe that 4 witnesses is as much applicable for 24:4 (as it is in 24:2). Because consider this: In order to flog/punish those who have committed adultery/fornication there first needs to be evidence (or witnesses) that they are guilty of said act, because how can you punish someone for having committed an act to which there is no evidence for.

Can you prove that 4 witness is required also for 24:2 in context?

Salaam Sstikstof,

You asked:

Quote
Can you prove that 4 witness is required also for 24:2 in context

24:2 reads as follows:

"The [unmarried] woman or man found guilty of sexual intercourse...."

So, if 4 witnesses is not required for 24:2 then how else would they be found guilty? In other words, how else would it be known that said individuals were guilt of fornication/adultery?
If 4 witnesses is not applicable for 24:2, then what other evidence should be used to convict them?
